    Hello All,
    How is everyone doing. I am going to try and ring the court again today. I am worried about getting my defence in. Its a bloody worry. I just wish that CEL had bothered in the first place to contact me to say what I had done wrong in the first place! Hope everyone is well?

      Thank you so much for this. It is really appreciated. Will I at some stage need to say that I had a disabled badge displayed and they had not replied to either letters that I wrote to them? Ypu might find this interesting:

        Sorry to bombard you with questions Mystery1,

        On the info you provided It also says to include email address and telephone number. Is this advisable?

        If it gets to court I want to say that if it is because I went over their allowed parking time, I was displaying a disabled badge and I believe that it is discrimination expecting a disabled person to get their shopping done in the same time that they expect an abled bodied person to get their shopping done. Where the disabled parking sign was listed it did not say anything about the time you had to park. Should this be mentioned some where in defence?

          You can add a point C just before the conclusion. Disability is not a strong point for me and i believe we have plenty more than enough to win as it is. The already should know who the driver is so it shouldn't cause any issues.

            Hello Mystery1,
            Hope you are well. Just come back from two weeks on holiday with my mum, to letters from the court. One saying they are received my defence and another saying as I have not replied they have issued a judgement against me and if I don't pay items can be siezed. I am so confused and worried. I was hoping to at least get to go to court. Looks like I have to pay £237. So gutted as if they had replied in first place I would had paid the lesser amount. I will upload scanned copies on Tuesday. I am going to contact the court and see what they suggest.

                    Hello Mystery1 and Kati,
                    I am back to work on Tuesday. As soon as I get a moment I will call them in the morning. The Co-Op have told me to pay and they will reimburse me. I am so tempted to do this as this is getting a bit stressful now. If I thought it was so they could take them to court i wouldn't hesitate. I will keep you guys posted.

                      In that case you pretty much have nothing to lose. If you lose (highly unlikely) the amount will be very similar to that on the claim form and you have been told the Co-op will pay this amount.

                      They rely on pressure to make people pay as they really don't want to go to court and, in fact, rarely do.

                      We have them by the balls but at the end of the day you have to do what you want not me or anyone else.

                      1 unlikely scenario, as a warning, you have been told DEAL own the "debt" by notice of assignment. It is CEL who are taking you to court. If you lost you would owe CEL money for a judgement of the court but technically speaking you could still be said to owe DEAL too. Only by paying is that real even if it's unlikely that both would chase for the same money.

                          Dear Sir or Madam,




                          In the above named case there has potentially been a contempt of court under CPR 87.17 & 87.18 namely that Mr M Schwartz and Ashley Cohen have signed statements of truth of which they cannot have had an honest belief in.




                          The claimant in the action was Civil Enforcement Limited. (“CEL”) (see attached claim forms). The claimant and their legal team should have been aware of an assignment (see attached assignment) from CEL to a sister company Debt Enforcement and Action Limited (“DEAL”). I also attach a pre action warning from DEAL in which it is clear that CEL no longer has the rights that the claim forms state. There could not have been an honest belief in the facts of the claim.




                          I would ask the court to refer the matter to the Attorney general for consideration of contempt of court using the power contained in CPR 87.17 4 (b)




                          “(b) the court may direct that the matter be referred to the Attorney General with a request that the Attorney General consider whether to bring proceedings for contempt of court.”




                          I am aware that several other cases, some which are on going, have very similar facts and that more than one such letter will be written.

                            Hello All,

                            I had a letter from the court saying that they were unable to get an appointment from the mediator so it would be going to a court near me and they would be in touch. Today I received a letter from Civil Enforcement saying " We are no longer pursuing the Parking Charge Notice originally issued to you and enclose a Notice of Discontinuance of the court action which was taken against you. The matter is now closed."

                            Thank you all for your support. I am so relieved and have really appreciated every bit of support you have all given me. : )
