My mum received a letter from Athena for parking in Lidl as the signage was not clear that you had to give a registration number at check out nor was she asked by staff at the till! I told her to just ignore it but she wasn't happy so I drafted the below email for her;
"Dear Sir or MadamI am challenging as Registered Keeper the above Civil Parking Charge Notice for the following reasons;
Athena ANPR Ltd does not have landowner rights and therefore is incapable of offering parking and parking contracts on this land.
No contract could have been formed in any case, as the signage – particularly the requirement to input a registration number on the way out – was insufficient to form one.
That, as Athena are not the landowner, and that the car park was in no way full with vehicles then the parking charge bears no relation to a genuine pre-estimate of loss (GPEOL) and is such an unenforceable penalty.
Please cancel this notice forthwith."
Yesterday we received a rejection letter which is way too long to type out & I don't know if I can attach a picture of it but can anybody offer advice please?
