Hello Legal Beagles.
Similar to a lot other posters here my fiance has received a PCN from Parking Eye for parking in an Aldi car park and we'd like to seek some advice from those more experienced in this area as this is a first for either of us!
The letter received states the vehicle was in the car park for 2 hours 6 minutes, exceeding the 1 hour 30 minute limit set for the car park. In this time my fiance completed a shop for her disabled mother (wheelchair bound) and 93 year old grandmother who is equally disabled, as well as our normal weekly shop. How she was supposed to complete all 3 shops in 90 minutes is beyond us, including the time to queue to get in, park, get them into the store and the reverse on the way out.
Since receiving the letter we responded to Parking Eye, however this was in error as we misread the letter believing it was a different Aldi store entirely that we would normally shop at (this store also has ANPR with a machine to enter the registration number) so the appeal we sent via Parking Eye's website was on the grounds that she had shopped at Aldi, with proof attached. Since then we have realised that it was the different Aldi, and the longer shop was with the family in-tow hence the longer shop. I've been reading a lot of advice here and on other sites recommending not to disclose the driver...but I suppose we have already done that.
After realising the above we have attempted to contact Aldi in the hope they would see reason in this but we have had not reply yet, and we are concerned that from 18/12/14 the charge increases to £70 from £40 - neither of which we could afford.
As we have already sent the appeal, albeit on incorrect grounds, do we have any basis on which we could send another appeal for example by post, or have we missed the boat on this?
If so, the final date for payment of the PCN is 01/01/15 so should we expect to be receiving a rejection to our appeal before this date as we have already appealed or do Parking Eye wait past this date before responding to the appeal?
Sorry for all the questions, as I say this is unfamiliar territory and we're very anxious about the situation.
