    Hi Paul,

    I'm in the same situation as yourself and just wonder how you were progressing with not paying it? i parked in the carpark in may 2013 and overstayed by 20 mins i too ignored the letters as advised by checking the internet. i have now received a cci on my credit profile as i have moved address so nothing was issued to me. i now have to pat £155 to ask the court to set this aside. i was thinking of just paying it in full if you haven't had any success.

      Hi M,

      Sorry to hear you've received a CCJ. At present my case is still progressing towards court. It's been assigned to the local court here in Brighton, although I had been contacted by the mediation service and confirmed with them I was happy for mediation on w/c 16th Feb, but as I've heard nothing more from them I assume DEAL have declined the offer and want to proceed to court.

          Hi M1,


          Just a further update. I called the mediation service regarding my offer of availability for w/c 16th Feb and they advised the case was referred to the local court in Brighton to proceed to trial. They would not tell me, but I could only assume that DEAL did not wish to undertake mediation.


          I've now received a letter from the local court in Brighton advising a date of 7/4/15 for trial, but also suggesting the judge believes the case is suitable for mediation, so I have again contacted the mediation service advising of my willingness to undertake mediation should DEAL be agreeable.


          I notice on the parking prankster website that several judges are now starting to strike out cases due to the DEAL not providing details regarding their solicitor M Schwarts when asked. An example letter was shown which I'm going to follow and send to the judge at my local court

                  Hi M1,

                  Just a further update. Have checked with the court as DEAL had to pay the £25 court case by today and parking prankster had quite a few mentions of them not having done so and those case being struck out, but it seems their admin team are being annoyingly efficient with mine as they paid it this morning!

                  I presume that mention in the local court paperwork advising I should ensure my defence is with them no later than 14 days before the hearing doesn't mean I have to submit it again, and that the original defence a filed a few months ago is all they need?

                    The defence is in. What is required though is a witness statement and any documents, such as letters, notices etc that you wish to rely on must be submitted. The assignment letter for starters should be used if you have it.

                      The assignment letter being DEAL's "final reminder before court action" letter, where it states that CEL have assigned their debt to DEAL? That's the only mention of the assignment I have.

                      I have no other witness statements, solely my original defence. There are no pictures of notices or anything as Co-Op sold the store to Waitrose 18 months ago so all CEL notices no longer exist in the car park

                        The assignment letter being the one that said CEL transfer the rights to DEAL for 87.5% of the "debt"

                        You should also put in your witness statement about not seeing signs, what the track staff told you etc.

                          Just an update regarding the letter I sent the court on 2nd March regarding getting the case struck out as many have.

                          The letter I received from the court this morning advises "The court cannot enter into correspondence with parties over a case". That was it. Short and sweet.

                              Some courts do that. Worth a tray though.

                              Make sure you meet the deadline for documents and witness statement.

                                Hi M1,

                                Called the court at 4pm on Thursday to check if case was still proceeding on Tuesday at 2pm and told it was. Just had a knock at the door and the postman delivered a recorded letter containing the N279 advising they are discontinuing the case. Obviously with it being bank holiday the court are unlikely to receive their copy until the morning the case is due to be heard, so I'll call the court Tuesday morning, but depending on how efficient their admin team is, and on what time Royal Mail deliver the letter, I half expect to be told that they haven't received anything at that point. There's also the possibility of course (with DEAL's reputation!) that they've sent me the papers and not the court in the hope I don't appear, but seeing as the court is only a 10 minute walk from my office I'm quite prepared to turn up as planned if the court advise me in the morning that they haven't received anything
