  • Aldi Parking Eye Sunday parking WON

    Hi,

I'm another person who's fallen fowl of an Aldi ParkingEye parking charge and new to the forum... Apologies if I'm going over old ground.

I parked in an Aldi carpark on a Sunday and found the pay & display machine wasn't working. (Unsure if this happens every Sunday).

Assuming the 2 hour restrictions therefore didn't apply, I parked for quarter of an hour over the alloted time and have been sent a parking charge as my car was photographed by ParkingEye – which I was unaware of after carefuly reading the signs.

The signs don't state that 2 hours of parking actually includes the time entering the carpark, finding a space, paying for a ticket and leaving!

I've read a few threads that suggests keeping an appeal letter short and succinct
but is it best to email an appeal or to send a letter recorded delivery so there is proof?
    – I'm obviously conscious of needing to act immediately and need an up-to-date letter template.

    Any advice much appreciated, thanks.

Hi LilDave and welcome to LB

Don't worry at all because we have @mystery1 here who is an absolute wizard at all things parking. Just be a little patient (he's not on at the mo) and in the meantime have a browse of the Parking threads, (esp. this one: http://www.legalbeagles.info/forums/...pany-victories) which will ease your mind xx

      Dear Sirs,

I, as registered keeper, wish to invoke your appeals process. The driver could not pay as your machine was faulty. In any event your charges are penal and not a genuine pre estimate of loss.

I am under no statutory obligation to name the driver and will not be doing so.

Should you reject my appeal please supply a popla code, at which time you should return for help with a popla appeal.

      Yours etc

If you get rejected and a popla code come back to sort out a popla appeal.

      M1

ParkingEye fine cancelled first time using the following short letter that I emailed

        Dear mystery1,

        You deserve a medal!

Using the letter template you provided, I've had confirmation from ParkingEye that my fine has been cancelled first time, without having to appeal to POPLA.

For anyone else that's fallen victim to Parking Eye, the thread below was my scenario and at the bottom of this reply I've added the short letter which I used and was successful.

I appealed online for speed and ease, rather than writing a letter and having to send it recorded delivery as proof.

I'd recommend doing the same and taking screen grab of the automatic notification that your online appeal is logged for proof.

Hope it's of use and good luck...

Thanks again Legal Beagles, this forum is a brilliant resource.
