POFA can someone explain - WON

Hi I have received a PCN from civil enforcement ltd.
After reading some advice I decided to write to them to say I rejected their charge as I did not receive it within the 14 days required by POFA.

However they came back to me and rejected my point stating there was no reference to POFA on the ticket so it did not apply.

I am confused can anyone help I don't want to appeal if I have my facts wrong.

Pofa only applies to the registered keeper. Without seeing any correspondence between you both it's hard to say whether it's the RK or driver they are chasing. It's hard to chase the driver if you don't know who it is.

Did you get a popla code with the rejection ?

Yes I got a popla code. The parking charge was addressed to my husband.

Also add in that the driver was not the RK and don't tell them who was

In my correspondence with them I did confirm my husband was driving. He was in macdonalds and wrongly thought because he was a customer he could stay parked outside. This was another point I gave in my letter as it wasn't clear on the signage that customers would be charged.

my appeal has been upheld on the basis of the parking co not providing evidence of a genuine pre estimate of loss
