    Hi everyone,

    First post here so please be gentle. I'll try to keep it as brief as I can, but apologies if I ramble on a bit.

    During August, I had some time off work & decided to take my wife out for a drink in Portishead.

    We decided where to go & headed off in my new car.

    The pub is located near the marina in Portishead, and it was about 21:00 and dark when we pulled into an area where other cars were parked, so I parked, we had a couple of drinks and went home.

    I have just received a "Parking Charge Notice" from ParkingEye saying that I arrived at 20:52 & left at 22:31. They also stated that it is private land and I need a permit/authorisation to park there.

    It is a £100 fine or £60 within 14 days.

    I am also expecting another fine as we went back for another drink a week or so later, thinking that it was just an area that we could park without any issues.

    I drove there last night to check the signs (as they said that the signage is clearly displayed at the entrance & throughout the car park) and noticed that yes, there is a sign at the large entrance area and a couple of other signs that are near a chained off area within the "car park".

    The signs were not lit throughout the car park, and as it was dark, I couldn't see any of them. Obviously, if I HAD seen them, I would not have parked there, and looking at the signs, all bar one make it appear that they are referring to the 'chained off area' within the car park.

    I have been told by work colleagues that I should say that a) I was visiting somebody who lives there, b) offer to pay £10 as a reasonable amount for parking for 90 minutes, or c) ignore it totally.

    What should I do, as like I said, I have been there twice with my wife & can't really afford to get another fine?

    Any advice on what to do within the timescale would be hugely appreciated.

    Hi CaptainChaos .... I'm sure someone will be along to advise you soon.

    In the meantime, could you maybe contact the pub you went to asking if they are aware of ParkingEye's involvement in the car park?? Does the car park belong to the pub, or some other place??

      I don't think the car park belongs to the pub - the outside seating pub area was right next to where I parked - the Notice I got said "this is private land, the car park is managed by ParkingEye as a permit/authorised vehicle only car park and those parking without the appropriate permit/authorisation will incur the parking charge"

        try and find out who it belongs to ... it might be worth asking at the pub anyway (they should know who the owner is) x

            If you knew who the owner was, you could maybe get them to waive it ....

            Have you thought about appealing to POPLA? I'm not sure if it will work (there are people on here that are really knowledgeable about PE fines, and I'm not one of them I'm afraid) - mainly I am just keeping your post bumped up :tinysmile_twink_t2:

                Nobody you can attempt to get it dropped with in these circumstances but never mind it's easy enough to get them cancelled by the tried and trusted method

                Appeal to parking eye who will probably reject it but in doing so you should get a popla appeal code which can be used to the desired effect.

                Dear Sirs,

                I, as registered keeper, wish to invoke your appeals process. The driver did not see any signage and in any event your charges are penal and not a genuine pre estimate of loss.

                I am under no statutory obligation to name the driver and will not be doing so.

                Should you reject my appeal please supply a popla code.

                Yours etc

                      Should I send the appeal straight away or wait a week or so (I may get another fine as I went there twice, due to not seeing any of the signs due to the darkness/unlit signs)?

                        I'm not aware of anyone who has lost if they follow my advice for popla.

                        I think overall popla wins are about 56% but some people appeal on mitigating circumstances which popla admit they do not take into account. Genuine pre estimate of loss on the other hand is above 99% at the moment.

                          Each one is a separate entity and should be dealt with individually.
