  • PCN court case discontinued - seeking advice on claiming expenses

    Hello,

    I attended my court hearing this week, but when i arrived i was told it was discontinued over a month ago. I had obviously received no letter or email explaining this otherwise i wouldn't have turned up.
    The Claimant stated that they had sent me a letter of discontinuance via post, but again, i obviously did not receive this.

    I am looking to write a counter claim for expenses, but i'm wondering how much proof of these expenses i need?

    Congratulations on having the parking company discontinue.

    There is a general presumption that the claimant will be liable for the defendant's costs that were incurred up to the date when the notice of discontinuance is served.
    However that does not apply to cases allocated to the small claims track, where the only reason for obtaining costs is the unreasonable behaviour of the other party.
    Discontinuing is not considered unreasonable, and if you unfortunately did not receive notification which was allegedly sent
    that is just unfortunate.

    Just take pleasure in having beaten the parking company who have lost out
