The defendant has received a county court claim form in regards to 7 PCN's issued from 2014-2016. Most of these PCN's are from either parking in a disabled bay or not parking within 'pay and display' bay.
These tickets occurred at a local retail park which gets extremely busy so at times there was no choice but to park there. The defendant was told not to worry about the tickets and to ignore. It worked since 2014 but these PCN's have now caught up with him!
The PCN's are issued on 2/3 different cars however the number plate has been the same (not sure if this makes any difference to the defence).
UKPC control the parking at this retail park and the claim is through SCS Law totalling to £1200.
The letter before action was not recognised as it was thought to be another warning letter. There was nothing on it to say it was a letter before action/claim.
Unfortunately the defendants personal circumstances haven't been the best in the last few weeks so apart from acknowledging the claim they have not had the time to do anything. The defence needs to be submitted within the next week so they really need to send this ASAP. They did think of paying the £1200 but were slapped out of it.
The Particulars of the claim has also been received
Apart from acknowledging the claim on MCOL they have not responded back to anything since receiving all the SCS letters.
The defendant is no where near legal minded so have been trying to find ideas on how to write the defence and is finding it very hard.
Is it best to post the defence of upload on MCOL?
