      Hiya

      I've received some more documents today from BW Legal which I think are a copy of something they have sent to the court rather than something I need to respond to. I'm not sure if they are significant?

      I'm worried that this might mean I'm actually going to get a court summons at some point and will need to appoint a solicitor?

      I've sent them to Kati so I'm sure she'll upload them soon.

            Hiya sorry I hadn't seen your last message.

            I've just today received and order to complete an N180 form - Directioms questionnaire. It says I failed to respond to a previous request though I never received that. I now have to send one by 6 Sep so need to get it in the post tomorrow to make sure!

            What does this mean and what should I do?

            I have to answer yes or no to:

            1. Do I agree to this case being referred to the small claims mediation service?
            2. Do I agree the small claims track is appropriate for this case?

            I also need to suggest a hearing venue, witnesses and dates.

            Does this mean I have to go to court now? Should I be getting a solicitor?

            Help please! Panicking now!!

              yes to mediation (it makes you look good )
              yes to small claims

              venue = your nearest court
              witnesses = none (you don't count here)
              dates = any pre-booked holidays etc... that mean you cannot attend on certain dates

                Thank you.

                I guess this means it's almost certain to go to a hearing then. Would it be sensible to start looking into a solicitor or would I be able to manage by myself at the hearing.

                I assume that BW Legal have decided on receiving a copy of my defence that they have a good shot of winning.

                  Witness is 1 i.e. you (or 2 if you want OH to witness that he drove and the signs were shite)

                  A solicitor would cost so much you'd have been better paying. A solicitor charge would only be recovered if the court finds the claimant behaved unreasonably.

                    That DQ question about witnesses usually says how many "including you" so you would put "1" in that box. It's an ambiguous question.

                      Hopefully we might be able to come to a conclusion at mediation if that happens.

                      I have to wonder how likely we are to win in court if they've decided to pursue the case anyway.

                          Decide what you'd settle for and stick to that. If that's drop it and i'll let you off with costs, so be it. If it's a tenner stick to that.

                          The mediator may be somewhat hostile to you as a litigant in person but their opinion is largely irrelevant. You won't speak to the claimant.

                          Have you ever spoken to KFC management with a view to them cancelling this ? (or via social media)

                              It seems my OH had not been aware that he needed to pay for the 45 mins he was there getting a KFC (I know!) on his way home to Yorkshire from an event there.
                              Management = people who get paid more to do less and generally talk shite.

                                Oh sorry I thought KFC Management was some kind of other company I should have been speaking to!

                                I actually hadn't gotten in touch with them (I think maybe it's Peel Centre that owns the car park) is it too late to try that now that the debt has been sold on?
