  • Pub visit & now court claim from ParkingEye

    Hi all,

I really need some help regarding a totally unjust parking fine from ParkingEye!

    Backgoround:

We went to a local pub on the 16/05/2015, parked in their carpark for over an hour. A week later recieved a PCN from ParkingEye.

It states the carpark is only for customers of the pub (which we were).... BUT we needed to tell the bar staff that we have parked in the carpark, so we would get any parking tickets! We didn't know this policy, hence we recieved the PNC.

I ignored the 2 PCN letters they sent & now I've recieved letters from the court! I went to speak to the manager of the pub & they tried to get it cancelled but ParkingEye told them it was too late! The pub have said this is all they can do.

so now I need to defend this claim. Summary, we used the carpark of the pub of which we were paying customers, we just didn't tell the staff we had parked!

Can anyone help with my defence?

Looks like the tail wagging the dog !! If Parking Eye have been employed by the businesses on the site then those businesses tell Parking Eye what to do and not the other way round. Is this pub part of a chain? If it is then start attacking the head office of the chain and get them to cancel. All it needs is a letter, or email, to parking eye telling them to drop the action. The pub copy you and if it proceeds to court then you show the court this and PE lose big time.

To late is not a valid response!

I assume that you went to the pub in the evening. What were the lighting conditions like? Could you see the signs? Where they lit?

It was during the day - a Saturday. TBH, I never noticed the signs.... plus it's a pub... & I've been going to it for sometime.

It is a chain. The manager verbally said - to put that they tried to get it cancelled in my defence. Also, I don't think the pub owns the land.

But there is a connection somewhere as you have to give the pub the notification that you are parked. Get the pub to write to parking eye asking them to cancel the ticket and put you on copy. This is to build up the paperwork for later if it is required.

I sent a email to Fullers & the pub manager called me. He found the receipt of the drinks ordered and he is going to contact parking eye.

He confirmed they do not own the land or employ parking eye... they manage the whole estate!

Also, this has happened to other customers & parking eye have refused to cancel the claim. He's going to get back to me once hearing back from PE.

Question - should PE refuse, what should I ask the pub manager for, in regards to buildng a defence?
              > receipt
              > email confirming they tried to cancel the tick?

              Thanks

                Hopefully they'll pull through.

File acknowledgement of service and let us know when you need to file a defence by.

Just spoke to the manager again.... because PE have incurred costs starting the court action..... they will accept £60 to cancel.

TBH, I think I'm going to pay up, rather than risking it!

                    Thought they might. Your call.

I wouldn't but i wouldn't be critical of anyone doing so.
