Or, you file an application form to the Court and pay the fee of £155.00. Provided this is accepted, you will be entitled to enter a defence and the matter will proceed along the small claims track, where you will need to file a few other types of statements / evidence.

Ultimately, this is your choice to make, but whichever choice you make, we're here to help.
Hi guys - first post on the forum

Very interested to read the above - I didn't know anything about the consent option.

Basically, I received a few Parkingeye tickets, which as per old advice - I ignored. This all happened mid - late 2013. I do remember receiving a letter from 'Northampton County Court' - however I distinctly remember typing in the address stated on the letter for the court and comparing it with the address found through searching on google - they didn't match. This, combined with the odd looking printed stamp (as opposed to a real stamp) on the letter, and the knowledge of scare tactics that Parkingeye use - I made the huge mistake of ripping this mail up too. After this, I do not remember receiving any further mail (ie. I didn't open a judgement letter), however I do not know how I would ever prove this.

Anyway between January 2014 - March 2014 I bought a new house under the help to buy / government equity loan scheme. The timing really was lucky here - the CCJ was actually put through in February, but apparently doesn't get picked up on a credit report for around a month after - my mortgage was finalised during this period I believe.

HOWEVER, obviously having ccj impacts my options. I am considering another job which would involve relocation and potentially a new mortgage. I only found out about my CCJ when attempting to order a mobile internet contract through EE when I had just moved into my house and was declined (would have been April-May 2014) - after which I reopened my experian account and found the bad news. It was for between £250-£300 which I paid straightaway. The advice I was given around this time was that the only way the CCJ could be removed is if it was set aside - however I would need solid grounds for this - which apparently I didn't have.

So my question is - will Parkingeye sign a consent form for removing my CCJ if I ask them? Is there any particular way I need to approach this communication? Is it too late to do this given it was over a year ago?

Some further information that may be useful is I believe I still have around £150 in unpaid tickets to Parkingeye. These were in place when I called them to pay the balance of my CCJ, however the operative on the phone told me I didn't have to pay that to have my CCJ settled - so I didn't. Would this be beneficial in terms of providing them an incentive to sign a consent form.

I really can't believe I let this happen over such a small amount (in context) - one of the things I have done in my life that I genuinely regret. I am excited to learn that there even may be the possibility of this CCJ being removed from my file. In any case, please tell me if I have misunderstood here, or alternatively if anybody could offer advice on my situation - I would be extremely grateful.

    Thanks in advance.

I am in the same position as yourself, I have contacted Parking Eye who have agreed to set aside by consent, they have signed a consent order I drafted and it's currently with the courts, I should hear something back soon. All the info can be found here:

The only way to find out for sure is to ask. Having paid i see no incentive for them to do so and in any eventa judge can block it but with a consent order that would be pretty unusual.

Appealing to their greed may help get over the fact you paid the CCJ. I hate the idea of paying but in your case it might get you out of a sticky spot and be cheaper they paying a bigger interest on another mortgage if indeed you can get one.

        Good luck,
        Thanks mate.

Specifically with reference to when you said:

"I managed to find a phone number for the company and got hold of an email address for their legal team so I've sent them a polite email kindly asking if they would be prepared to sign a consent order if I paid the charges in full"

Do you have the email address or did it seem that I would need to call them first (ie. did it feel 'cold calling' them effectively with an email from nowhere would be negative, or was there no connection between the call and the mail?). Also, could you let me know how your mail went to them, given it was successful?

Thanks again for the quick responses guys.

Sure, the legal team at parking eye can be reached via this email address:

          enforcement@parkingeye.co.uk

Note they take around 10 days to respond to an email so you'll have to be patient; it can take a good few weeks before you get your issue resolved... Good luck
