Hi, I hope someone can help me with this?
I parked at the royal free hospital a few months ago, I was a few minuites late for a medical appointment which I had travelled from the middle east to attend (working abroad at the time) I drove in, couldn't find a space for quite some time I do remember, and after waiting driving round for a while I eventually parked and ran inside the hospital (now late and panicking after a 6 hour flight and 2 hour drive) I did not see a machine to pay at but did see a sign which I hurriedly snapped with my phone with the intention of paying for my parking as soon as I made it to the waiting room. I was told by the receptionist to wait in the waiting area as the doctor cold call me a any time, so I say down and got my phone out to Pay by phone. Unfortunately inside the hospital the reception is horrendous and to make matters worse although I had an old Pay by Phone account from when I lived elsewhere and on my old phone I hadn't transferred it to my new phone. So began my nightmare of attempting to download the APP again unable to call as the phone kept saying call failed no service, I eventually managed to get onto the hospital wifi after several very frustration attempts to down load the app and then update my card details with mobile series of periodically one bar that would drop out just at the crucial moment. Finally at whilst having needles and tubes coming out of my arm on one side and my credit card and phone in the other (the nurse looking at me like I need some other kind of medical help) I managed to pay for 3 hours parking as far as I could remember, thought no more of it and made my way back home and back to the middle east. I returned back a few weeks ago and got a county court business centre claim form for parking on private land in breach of the t+c's.
I don't want to get a CCJ but I feel its too late to avoid court action appearance too? can I defend this? if it gets ruled against me do I get a CCJ on my credit report even if I am prepared to pay in the event of my losing (not sure how unless I overstayed maybe but even then seems exceptionally harsh at 100 claimed plus 25 court fee plus 50 solicitors fee) I parked in good faith, for medical reasons, for an appointment I could not miss, and received no other mail from them (out of the country and we have a US style open mailbox along with 5 other people where mail is often missing wrongly posted)
Can anyone help me here before I just pay 175 for a parking fee I believe I paid as soon as was possible, unfortunately I cannot remember when I left the car park itself but do remember being blocked into the space I was in for a while. As the ANPR only records my vehicle on the road outside and not whilst parked how can they have any accurate idea of how long I was actually parked for in a bay, and also how could I avoid overstaying if I was blocked in?
