Posting on behalf of my brother. He's just informed me he received a £100 fine for staying 50 minutes over a free 2 hour parking area some time ago.
He ignored the letters though did admit he was the one driving. He just recieved a claim form from parking eye asking for £175 (original amount plus solicitors and court costs). Issue date was 9th of March.
I have registered online and requested the 14 day extension along with contesting jurisdiction but yet to file my brothers defence. Thought I'd get some advice here first.
My brother has no idea about any original dates and has no pictures of signage or anything.
So basically looking for a good defence, obviously paying 100 for staying 50 minutes over a 2 hour parking zone is criminal. As I understand it is just an invoice of potential losses? What's the odds of them taking my brother to court? Can they charge for solicitors fees in the small claims court? Won't it cost them more to even file it?
