Well Beavis is an issue. It is also being appealed to the supreme court so once we get official confirmation it has been appealed we would naturally request a stay again pending the result.
We have attacked the signage (contract) in the defence. Nothing in Beavis relates to the actual contract between the contracting parties. This is a winnable area but not a gimmie.
We have not extensively attacked keeper liability. We should probably write to the claimant asking for a stay until Beavis is resolved but failing an agreement on this we should ask for permission to amend the defence so we can attack keeper liability fully.
