  • Taking action against DCB Legal

    Good afternoon to the group.

    Just a quick one. I have been fighting with DCB legal for over six years now regards an alledged parking offence, where they said their client had stated I had broken the terms of the parking agreement by parking in a bay, then crossing over the road to another shop, thereby breaching the parking contract. When I asked for evidence, they sent me several photographs of my parked car within the bay, but nothing showing me crossing the road. They did state that one of their employees witnessed it, but could not provide any evidence of it.

    As I am aware, a PCN is state barred after six years, this PCN was issued on the 16/10/2024, and therefore should have run out. I engaged several times with BCD legal requesting clarification of the evidence that I had asked for, and they refused to provide it. When I chased again, on the 24/09/24, and again on the 16/12/24, they refused to respond. Then on the 03/01/25 they contacted me by email informing me that on the 30/12 Judgement had been entered against me.

    This feels like they have acted very unethically, refusing to respond to my calls in order to push through a verdict by default, knowing that their evidence is not going to stand up under challenge. I am looking at taking them to court and seek compensation from DCB Legal as the agent who has acted on behalf of their client, but they will not respond to my requests for the name of their solicitor, the court or the judge at which the verdict was made.

    Any advice would be greatly received, as I am sick of these keyboard bullies who refuse to behave in an ethical way and tarnish the legal profession.

    DCB Legal are stating that a default judgment against you was entered on 30th December 2024.
    If that is correct you have been sent court papers.
    Did you receive any court documentation?
    If so did you not respond to the court?

      Hi there,

      No, no court papers were received and I received no court paperwork.
      They have had my email address but also never sent anything advising of this paperwork being sent either, hence my query.

        Forget about taking legal action against them. You don't have a claim for compensation and it will cost you in money, time and stress.

        You need to ask them in reply to their email of 03/01/25 for the claim number, which you will need to request the court set the judgment aside

        If you didn't respond to any court documents the default judgment would be entered against you on receipt of the claimant's application. It will be a rubber stamp process

        It is not unknown for unscrupulous persons to lead their victims to believe there have received a CCJ in an attempt to have them pay an alleged debt.
        You can eventually discover if there is a CCJ registered against your name, but that register may not be updated for several weeks!
        Similarly Credit Reference Agencies will eventually contain that information
