  • Prep for court date

    Morning all, I've read so many posts I think I've confused myself! Could use some advise on what I need to have ready for my court date.

    Its the usual story. Knew nothing about a parking ticket until a CCJ appeared on my credit file. Bit of digging and it turned out to be from Gladstones Solicitors for parking in a 2 hour free parking supermaket car park for 30 mins. It seems that a company called LPC have a private car park opposite that shares an access road so I'm assuming they've 'mistakenly' issued it and conveniently sent everything to the wrong address. Did find some local press that suggested there has been a lot of issues with the car parking at that particular supermarket.

    The CCJ lists my old address but mail forwarding was in place before I moved out (there was actually a few weeks overlap between me moving out of my old place and into this one as repairs needed doing). I did a SAR to both Gladstones and LPC. Not a thing back from Gladstones, LPC said they couldn't find anything against the address.

    Filed my N244 and this is where my confusion began. I mistakenly thought it was a paperwork exercise that would either be allowed or denied and if the parking company then attempted to proceed again it was essentially reset to day one and I could respond accordingly however I've now been sent a court date. Fortunately I haven't actually got to actually go to court as its being done via phone.

    This is where I am stuck, what do I need to prepare? Is it just going to be a recap of the facts already stated on the N244 or do I need to get a solicitor involved and / or prepare case law or know the relevant parts of the law?

    My main priority is to remove the CCJ, obviously I'd rather have no fine at all as its a bit of a scan but frankly if there was the option ow of going back to a £60 fine I'd probably pay it just to get it over and done with!
