  • Template for PCNs in Sheriff court Scotland

    Hi folks, I have tried the search function with little joy it seems.

    I have received a small claim in sheriffs court for 8 PCNs, and am looking for a template, seems the ones I am finding are for south of the border.
    I have never received a PCN for the alleged offences and don't recall ever parking at the alleged location.

    Spoken to Citizens advice and they recommended I simply respond that although being the keeper of vehicle, I have no recollection of who the driver was at the time of alleged offence and furthermore I have never received any notification of a PCN until this court letter.

    Can anyone recommend if this reply would be sufficient, or not detailed enough? any templates to use?

    SAR to the parking company.

    I don't know if this applies North of the Border but also a CPR 31.14 request to the solicitor requesting copies of all they intend to use in court and in particular the PCNs and copies if the signs that created the alleged contract.

      Thanks for the response, I believe I cannot use the CPR31.14 as it has already went to small claims?
      Also, I'm not sure if I can use the SAR as my final response date is 19/12 (2 days), or would the SAR effectively delay/defer the small claims?
