  • Gladstone response to my submitted defence

    I was recently issued money claim from Gladstone Solicitors acting on behalf of UKCPM. Their claim is that my vehicle failed to display a valid permit for parking in allocated bay to my flat. Parking management was brought in about 2 1/2 years after the purchase of the flat.
    Part of my defence was that there is no requirement to display within my lease and that they cannot simply offer parking at a cost which previous was free.

    I have now received a letter from Gladstone whom are responding to the defence i submitted on MCOL and are requested that I send them a copy of the lease. Considering they have asked to see my lease I'm thinking they are not sure themselves their client has a valid claim.

    Am I under any obligation to provide them my Lease even though they were the party who raised the claim?

    Did you mention the lease in the defence? If yes, you are obliged to provide a copy of the relevant provisions of the lease. I wouldnt give them all of it at this stage, rather id just give them the relevant pages.

      I've received their DQ where they've opted for mediation but I've responded against this. I'm now preparing my paper work and looking through my lease and found:

      "No term of this lease (other than clause 8 hereof) shall be enforceable pursuant to the Contracts (rights of third parties) act 1999"

      Does this mean the parking company have a valid claim against me or they cannot enforce the charge?
