    Yes I realised after about the driver details, honesty does not always fall in your favour. I now am not sure whether to offer a payment that I think is fair even though it’s very unfair or to stick it out with court being the next step.

          Hi again
          i have today received a letter from Premier Park stating they have passed my case onto their Legal specialists BW LEGAL , a little late as they sent something weeks ago it states as I both failed to pay or appeal the current balance of £160 has to be paid within 14 days which is basically the same letter I received weeks ago.
          i appealed to both Premier Park and Popla within the 28 days does this not count ? Or are they suffering from selective memory ?
          They have now added a paragraph threatening that not paying will affect both my credit and employability as the CCJ will stay against my name for 6 years and that they can commence enforcement proceedings against me.
          all very threatening
          Any Advice please ?

            Does it say "letter before claim" or similar? If not then ignore or point out their failure to respond to your previous letters If it goes to court then it would be frustration if contract as events outside your control prevented you from complying with the requirements of the contract.

            If they are claiming against the keeper then they can only claim for the amount of the original PCN. Even against the driver they cannot add to the amount if it us not stated on the signs.

            As for the CCJ, they are telling half truths agai . If you lost in court and didn't pay within a month then, and only then, would the CCJ appear on your credit record

                    Hi
                    Nothing on the letter saying anything like that, just telling me I have 14 Days to Pay or court proceedings will be applied for, what I will be liable for should I lose, how my credit rating will be affected in the Future and on the back a list of various ways to pay .
                    so it is Pay up or Take them on in court.

                      It's difficult to say whether it would be deemed to be a letter before action from your description.

                          This is the second of these i have received in a month both the same except this has an a letter from Premier Park informing me that i deal with BW LEGAL from now not them.

                            Ok, so that in itself is not an LBA.......possibly a precursor to one.

                              Hi
                              Today we have received a LETTER OF CLAIM consisting of a claim against me for an appearance in county court a form enquiring to our income and expenditure, and a form for me to reply on if I agree I owe the debt ( this fine ) or some of the debt or if I dispute it if I am willing to pay or not and an form with info on citizens advice etc.
                              i have to reply before the end of the month, to be honest I am the wrong side of 60 for this stress so do I go to court or offer part payment to end this now as it is starting to take over my daily thoughts now, Advice if possible please .

                                So write to them pointing out that this was frustration of contract in matters outside your control preventing you complying with your contract and the BPA Code of Practise mandates a grace period of at least 10 minutes at the end of parking. The timings they have are not parking, they are while the car is moving and it certainly takes more than a minute for parking to commence after entry and more than a minute after leaving the location of parking to reach the camera
