  • Ias claim denied

    Hi there

I received a parking charge notice a few months back which I disputed with the operator, they upheld their claim against me, so did the Ias (I gather this isn't uncommon) now it's with debt collection plus who sent me a letter.

Should I pay under protest and take them to small claims court? I'd rather not risk a ccj.

    Thanks

You don't take them to the small claim court, they take you.

You will only get a CCJ recorded against you IF they take it to court and IF you lose and IF you don't pay within 30 days.

So if you need help with the charge then post up a redacted copy of the PCN received and your appeal.

Oh good - lots of misinformation out there...I did Google for about an hour. Thank you. I don't have the original pcn to hand unfortunately but I'm pretty sure I'm in a good position, the land owner went bust throughout covid before I parked there, I only parked there for 5 minutes by mistake until moving to the space next to it which I'm allowed to park in (I believe the camera thought I was still in the original space), I've appealed properly and timely so I'll just wait and see what they do next I guess.

So you edit so that the identity of the driver cannot be inferred.

So SAR to Parking company to get the documents
