    Hey Legalbeagles,

    The driver was driving and parked and the registered keeper received a parking charge. The driver attended Costa which is on the opposite side of the retail park (within the car park) and didn't notice any signs regarding parking. Highview are claiming that the driver exceeded the maximum stay (presumably 2 hours).

    The driver hasn't kept receipts of the Costa visit but has transactions in their bank statement relating to their stay. Driver is contemplating asking the Costa manager to defend their case to send to appealpcn.co.uk. According to the charge, a rejected appeal to POPLA will result in the full charge of £100 rather than the reduced £60.

    The driver will be grateful for any guidance relating to the best form of appeal.

    Yes, get the driver to ask Costa to cancel.

    Unless it's on the reverse:

    Dear Sirs,

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

    First class post with a free certificate of posting from a post office.

    When they reject you appeal to POPLA with all the other POFA fails.
