  • Smart Parking Ticket HELP

    Hi would be grateful for some help , my son was drove into a car park which is run by Smartparking and controlled by ANPR it is not connected to any supermarket or other business .

    On arrival and having found a space he couldn't find his wallet which had all his cards and cash in he got out of the car to look at the terms as it was after 5pm he wasn't sure if payment needed to be made but it said it was 24 hours, he then immediately called a friend who he had been with to see if his wallet was there , eventually his friend found it on his driveway !!

    my son immediately left the car park to go and collect it, but 13 mins had elapsed and I have now received as I am the registered keeper the request for payment £60.
    Do you think if I appeal giving the facts I would have a chance of winning not sure how to play it, but he never left the car park and seems unfair given the circumstances.It was issued in England I can appeal online .

    could you advise of the best letter to send as appeal I was told by another member on a forum that they wouldn't be interested in what happened , but I was confused as the best letter to send I have studied all the stickies etc but am still struggling I note the notice mentions the beavis case and says that a 'PCN issued on private land is enforceable and that the court rejects claims that such charges are extravagant ect ect ...'

    You have a good chance of winning though and if you don't win at popla then you can name your son and your own liability is over.
