    Try the manager of Sports direct to see if they can help. Might have been better if you were buying but worth a try.

    Also appeal to Smart.

    Dear Sirs,

    I, as registered keeper, wish to invoke your appeals process. The driver did not see any signs and was a customer of Sports Direct. I note your notice to keeper is fundamentally flawed when compared to PoFA 2012 schedule 4 para 9 in several aspects .

    Should you reject my appeal please supply a popla code.

    Hi guys,
    Im in the exact same situation here. went to matalan in leicester and parked for 30mins while a mate sat in the car. Car park had entry and exit camera and I have recived a NTK. Been reading through the forums and wanted to stay tuned with this one as i can relate to this situation. I contacted the store to see if they can revoke it and the manager said that they do not run the car park anymore and i should deal with SMART. [MENTION=5354]mystery1[/MENTION] is the letter that you have stated above sufficient to send to them or would I need to add anything. Your help is much appreciated.

        HAHA wish I could. Once I get a rejection letter from SMART and get the POPLA code are you okay to help me with the POPLA appeal pls?

            I sent my appeals letter stating the following. Should be okay right?

            Dear Sirs,


            I, on behalf of the registered keeper, wish to invoke your appeals process. The driver did not see any signs and was a customer of Matalan. Any proof of purchase from Matalan can be provided upon request.


            The alleged 'PCN' states the entry and exit of the vehicle from the car park, but does not state the period the vehicle could have been parked for, and evidence of the vehicle being parked.


            I note your notice to keeper is fundamentally flawed when compared to PoFA 2012 schedule 4 para 9 in several aspects.


            There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 or cancel the charge. I will only appeal further if you offer POPLA, the only independent ADR with a scrutiny panel and trained Assessors. The 'IAS' offered by IPC firms will not be used, for well-documented reasons.


            The charge is baseless but I realise that you may have nominal postage costs. Equally, I have incurred costs for responding to your junk mail dressed up to mimic a parking ticket. It is clear that my costs and yours, at this point, do not exceed £15 so this is a formal “drop hands” offer. I remind you of the duty to mitigate any loss, so withdraw the spurious charge within 35 days and I will not pursue you for my costs.


            I hereby give notice of withdrawal from this alleged 'contract' which was never properly offered nor expressly agreed. This 'contract' is cancelled and any obligations now end.


            Should you reject my appeal please supply a popla code.

              It should do any harm. Not knowing that Smart are not in the IPC and letting them know that you don't know that might encourage them to keep at you.

              Should still get a popla code and doesn't identify the driver.
