CE Parking Ticket - Customer Free parking

Hiya,

I have received the CE Parking Ticket as below as this site used be free customer parking but lately changed with poor signage it seems.

I'm trying to sort this out with the site shop owner, meanwhile I thought to post here with regards to POPLA complaint of NTK to appeal against. I received this by post yesterday (23/12) and I hope I need to appeal in 28days.

Could you please advise what points should I focus on?

Typical CEL NTK.
Just write to them:

Dear Sirs
I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not anticipate receiving any further communication from you on this matter, apart from confirmation of no further action and my details being removed from your records. This includes communication from any Debt Collection companies you care to instruct.

They may or may not accept it.

Make sure you do not identify the driver with CEL, on here or with the shop owner!
