  • Smart Parking PCN, is it issued correctly?

    Hello,
    Ive just received a parking charge notice from 'Smart Parking' having a look online I have found several suggestions because the contravention date (15/08/2023) and Issue date (13/09/2023) are more than 14 days apart that I don't have to pay? I have also seen some information on Citizens Advice Bureau website stating it needs to say 'Protection of Freedoms Act' for this to be the case, I can't see this anywhere on the letter. Would somebody be able to clarify for me wether I need to pay this PCN or can appeal? If I can appeal what is the best way to go about doing this?

    From what little information you post, you would seem to be correct.

    However suggest you post up the Notice to Keeper, removing identifying details but leave in dates and times,
    Photo of the signage may be useful, if available

        Would suggest a letter along the lines of:

        Dear Sirs,

        I have just received your Parking Charge Notice xxxxx for vehicle VRM xxxx

        You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

        There is no legal requirement to name the driver at the time and I will not be doing so.

        Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.
