  • Help please - Final demand but no original PCN

    Hi all,
    I received a 'final demand' from One Parking Solutions in January but have never received the original parking charge notice. I wrote to them as such stating this and received a response saying they were still pursuing it as they had 'issued' the PCN by post (prior to xmas). I have just sent another letter and addressed it to the complaints dept citing the Freedom Act quotes as advised however on reading that act it states:
    8 (6) A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so “given” for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose “working day” means any day other than a Saturday, Sunday or a public holiday in England and Wales.

    They have responded today using the above to say that they uphold the charge as they 'assume' receipt of the PCN and I can appeal if i wish , however they sent that today and the appeal time ran out Saturday! I now don't know how to play this as really don't want the stress of debt collection/court but also don't want to pay based on the fact i never received the correct paperwork.
    I would really appreciate some advice on what to do now
