The named owner of a vehicle has received 2 PCN's in the post by G24, an IPC accredited company following the driver's apparent infringement of the parking contract as stated on the signs. This took place in a secure, residential car park behind a property where the owner of the vehicle is a tenant.*
Fine 1: Photos taken of the car where the driver parked on the 21/11 and invoice raised by the parking company on 29/11 (Would not have been received by the owner of the vehicle until several days later)
Fine 2: Photos taken of the car where the driver parked on the 29/11 and invoice raised by the parking company on 04/12 (The owner of the vehicle had not been made aware of the first fine before the driver was issued with the 2nd)
The space where the driver parked is easily large enough to park a car, it blocks no other vehicles or any entry/exit points. Please see attached photo of red car and of grey car. I have also attached photos of the sign which is up in the car park in several locations. The majority of spaces are marked with numbers to indicate which property is allowed to use it. This one has been left unmarked.
Points to be made:
*- The space is of almost an identical size to all other spaces in the car park and as such could easily be mistaken for a parking space.
*- There are no markings e.g. hashed lines, or "no parking sign" to indicate that this area is not a parking space as you would expect, and as you see in other car parks. As such, it can be assumed that the sole purpose of this lack of markings is to deliberately mislead drivers, hoping that they park in this space so that the parking company can claim a fee. This lack of markings seems deceitful, unfair, and improper.**
*- As this car park is used by residential properties, and this space is not specifically designated to any property, there has been no loss of earnings to any resident, parking company, property management company, or landowner so it can be assumed that the "genuine pre-estimate of loss" would be nil.
*- It seems unfair to issue a 2nd ticket before the owner of the vehicle had been made aware of the first apparent infringement. The only notification came by post to the owner of the car and there were no physical indications e.g. a yellow ticket on the windscreen to make the driver aware of their "mistake"
*- Finally, the parking company do not have records of the number plates of "pre-approved cars" and as such, they would not be able to enforce parking tickets on designated parking spaces even if they were being misused.
The owner of the vehicle has spoken with a representative at the property management company (circa 200 employees) and whilst he knows they work with G24, he had no record of my car being fined and was unaware of how he would be able to intervene. The representative also stated that as they only manage the property and are not the freeholder so they would need to gain permission from the freeholder before adding any additional marking to the car park.
Any advise on this issue/how to proceed would be very much appreciated.
