Parking Charge Notice for my mums car

Hi,

My mum received a parking ticket which was received after she had gone on holiday. Now she's back and has received a Parking Charge Notice from that day as the car was parked in a car park after dropping her off. Is there anything I can do to appeal this? It states it needs to be paid within 14 days and was sent on the 9th November. Obviously she didn't receive the notice until she had arrived back home from Spain.

Whilst waiting for ostell edit your post so the identity of the driver cannot be surmised. Just refer to "the driver".
Also post up a redacted photo of the PCN, and if possible photos of the parking signs

Post up the Notice you received, with identifying details removed, but leave dates.

This wan't anything to do with parking at the station was it?

No, it was a car park next to sports direct that everyone usually uses to turn their car around in so they can then drive up the high street without making an illegal right turn. So idk if the driver took far longer in the car park than allowed or if in fact they had turned her car around there again later on that day. I'll add a photo of the PCN in a minute once I've altered it as instructed.

As requested edit all your posts so that the identity of the driver cannot be inferred. Do this before the edit button times out or you could be snatching defeat ot of the jaws of victory. That PCN doesn't look as though it complies with the requirements of POFA to hold the keeper liable and therefore they can only chase the driver who they do not know at the moment.

I will try and post up why it has failed shortly.

That PCN does not comply with the requirements of POFA. Here's POFA Look at paragraph 9 and see what is missing.

For a start they have not stated the reason for the charge. Stating just Breach of conditions is insufficient. 9 (2) (c)

No period of parking 9 (2) (a)

9 (2) (e) is not there

9 (2) (f) is not quoted correctly

See if you can find some more.

Do some reading to see around the forum to see what POFA is all about would be a good start !!

Your mum appeals to the letter denying any responsibility.

Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with many of the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to,

• Failing to give the period of parking required by 9 (2) (a)
• Failing to describe the reason for the the charge, required by 9 (2) (c)
• Failing to give the invitation to pay in the format prescribed by 9 (2) (e)
• Misquoting the required statement prescribed in 9 (2) (f)

You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

Send this as an appeal to wherever the notice directs you to. Send first class mail and get a free certificate f posting from s Post Office.

This will not kill it but with the response you should get a POPLA code and then you appeal to POPLA and with POFA failures they should accept your appeal. If you read POFA see if you can find anymore reasons for failure

The POPLA appeal will also include the unclear signage as how can you see that sign is you drive in from the left and then walk out.

I couldn't find anything else I thought was wrong with their letter so I've copied and pasted the template above, but also included my mums full name and license plate number, and have sent the letter off first class with proof.

Now I've sent it though I realised that I haven't included any other details such as her address or phone number or anything! Will it still be OK?

They should know the details from the PCN number. As long as you've put that in then it should be OK. You don't want to give a phone number !!!
