Letter posted to Gladstones (with PoP, of course).

2 Questions:-.
Having Acknowledged online to the Money Online Claims site, do I need to post a signed copy to them? I don't want any problems of procedure.
&
If I don't hear from Gladstones, when should I prepare and post my defence - on-line, I assume, or do I need to post copies of everything or will scans etc suffice? [28 Oct is the last day for receipt]

Usually there are no problems with acknowledging online. You can always check the claim status online, or phone the court, to make certain all is ok.

The defence needs to be 25th October? (33 days from claim issue date).
How you submit will depend to some extent on what. if anything, you get back from Gladstones.
MCOL is rather limited re the amount of info you can send.
You can always send it as an email attachment to the court if you cut it fine. If you would rather post it to court, allow min 2 days & send via SignedFor (trackable) post.

If you counterclaim at the same time as filing your defence (ie on same defence statement as a follow on from the defence) you need to pay a small fee (About £25 or so upwards.........sliding scale depending on the amount being counterclaimed.)

The saga and process continues.
I have submitted my Defence online within time limit (with attached evidence scanned) and a Counterclaim, paying the £25 fee for such.

I have now received a ‘Notice of Transfer of Proceedings’ with a ‘Notice of Proposed Allocation to the Small Claims Track’, which says that I ‘must complete the Small Claims Directions Questionnaire (Form N180)’ to my local Manchester County Court and serve copies on all parties’.
Does this mean there has been no decision based on my Defence yet? – since they are asking if I wanted to go to mediation?!? [I dispute the ‘debt’ entirely]
The Directions Questionnaire just seems to ask if I agree to the Small Claims Track, and asks if I agree to its being referred to the Small Claims Mediation Service.
Do I just accept this?
And, I haven’t had anything back on my Counterclaim yet. Should I be worried? – or chase this?
I’d appreciate your help, please.

There usually won't be a decision until/unless there is a hearing.

Yes to Small Claims, & personally I would say 'yes' to mediation. (The courts like to see 'reasonable' behaviour.)

Check with the court to make sure the counterclaim is filed ok. The other party should have responded to it.

Make sure your DQ is filed on time & get proof of posting/sending a copy to Gladstones.

Hello, Charity. Thanks for guidance.
I've today posted/served copies of the N180 on both SIP & Gladstones for the Small Claims Track to Manchester County Court (with POP, of course) and I am to deliver N180 into the CC in Manchester tomorrow (before the 18 Nov deadline). I now wait to hear.
[As always I have had NO communication from either SIP or Gladstones]
I'm checking tomorrow morning on my CounterClaim directly with Northampton.

Hi Charity,

An Update on this case.
I have now received a Notice of Allocation to the Small Claims Track, to which I (and the other side) have until 4pm 3rd April to confirm or not that I agree to the claim being dealt with on paper, without a hearing under CPR 27.10. (They do agree)
I have submitted my defence, 'their claim is without merit' in my opinion as, in essence, we bought and have 2 parking tickets to cover the whole time we were parked. But still they persist!
Because of this, and reading a little elsewhere (a MSE forum) where they suggest NEVER proceeding 'on paper' as their papers will be better than a layman's(!) AND, being seriously annoyed about this and being able to attend a Manchester tribunal/court for a hearing to stand up for myself, I am unsure whether to confirm 'on paper' or B 'do not agree that the claim be dealt with on papers alone'.
I am quite prepared to go in and show the tickets I still have and long correspondence I have submitted and 'make a stand'!
But you suggested previously not doing this; instead showing a reasonableness that they have failed to show.

I did separately submit a counter-claim, (as stated above) for my enormous time expenditure in this sorry tale! But I understand that if, in somme weird way their case is accepted, against the facts, I have almost NO chance of winning this claim (It's about £220).
What is best to resolve this in my favour, do you think? (This is all uncharted territory for me.)

[The whole thing did go dormant for months until the case of "SIP Parking v William Dyer Electricals Ltd D1GF2Q7F under Dist Judge Iyer on 18th Feb. (I can't find what happened there.) But my case has now resurfaced.]

I'm sorry to ask, but could you please 'nudge' Charitynjw kindly to take a look at what I have just posted on this case. I need to act in the next few days and I have a Uni re-union away from home on Easter Monday to Wednesday. The deadline is 4pm on 3rd April (Tuesday).[After 30+ years sobriety will not be on the agenda!]
In return, I have offered to take photos of car park signage for another 'member's' case if it is still needed, against SIP.

You object to the paper hearing as it puts you as a litigant in person at a disadvantage against a legal professional and you would like to be able to question their representative about the matter in your local court. They also don't want to have to pay for a local rep at your local court instead of their own.

Search on the Pepipoo private parking forum and you will find many responses to this standard Gladstones request.

I am endeavouring to reply on-line to request a hearing for some reasons specified on a Pepipoo forum re Gladstones.
It's not clear or an easy process to do this, though!
This is ALL such a pile of xxxx - that a lay person should be hounded by such an unwieldy system for a bloody parking PCN, issued in error when I have 2 valid tickets for the whole time the party was parked!!!
Some 24 working hours of my life over 15 months to defend against THIS.
The only thing they have in their favour is that THEY know the paperwork and process required. Grrrhh!
And they churn it out in minutes while we ordinary folk have to read and read to understand the process. And it's 7 months since the last action so I have to familiarise myself again with it, while they do it full time.

I think you have to object on paper, with a letter included with the return of the DQ, in a similar manner you received the request from Gallstones.
