  • Parking Eye - PCN Advice needed

    HI All,

    Any help would be appreciated.

    I received this and it's completely confused me. The driver obviously didn't realise the car park charges were 24hrs. It was past 6pm the car park was empty. I've been on holiday since the alleged date, so 14 days has passed but despite this the attached states so many dates, I'm uncertain what i'm supposed to be doing or if it is even legal?

    ParkingEye are usually pretty good with compliancy of Protection of Freedoms Act.
    Could you post up the reverse side?
    Also, do you have pics of the site signage?

        The site signage is what the alleged contract is based on, so yes, if you can get pictures, do so.

            Personally, I can't really see a way out of this one.
            The signage appears to be very similar to the 'Beavis' case.

            Even given that the parking event may have been 'after hours' & the car park was empty, part of the 'commercial justification' argument in PE v Beavis was that the parking co is within their rights to 'make a profit'. The 'genuine pre-estimate of loss' argument, which was previously used to fight penalty clauses in breach of contract cases, has largely been torpedoed by this SC ruling.
