  • Need Help on PCM unfair ticket and taking to CCJ

    I have a Country Court Judgement against my name due to non payment of PCM parking ticket.
    A ticket was issued to me on 31st Oct 2015 to the address where I lived until 26th Oct 2015, since then I have lived at my current address and during all this time I had no letter or any form of communication to identify me that a ticket was issued to me and all the letters were going to my old address which were not forwarded or returned by the current occupier.
    During my credit check today it came up that I have a CCJ which is from Jan 2017 and was asked to contact the court for further information.
    On contacting the court I was referred to a Gladstone solicitor who then forwarded me to DCB Ltd and I was told to pay £350.89 to settle this. I am taking a new job and was ment to start on Monday but due to the CCJ under my name I cannot start my new job.
    I have currently paid £350.89 with a hope that if I settle this then there would be no negative impact on my credit and would be able to start the job.
    I work in banking/financial sector so now I am concerned about my future as from online research it says the CCJ would stay on my file for 6 years and worry that I would never be able to work in banking/financial sector.
    Please advice as this was genuinely not my mistake and I had no communication at all about the parking ticket. Please advice if we can file a case and if can remove CCL from my credit file.

    As I understand matters even paying the sum asked will not remove the entry from the credit files, it will continue for the 6 years, though marked as paid. You option would have been to apply for the judgement to be set aside, but this will cost about £250. I don't know if it can now be done as you have paid.

      Gladstones are solicitors
      DCB are debt collectors.
      Who is the parking management company that issued the ticket?
      If you could have this set-aside, what would your defence to the original claim be? (Apart from it being sent to the wrong address).
      & have you updated your details with DVLA since you moved?

        PCM is a company which issued the parking ticket. I changed the address on my driving license on 1st week of November 2015 and at the time I wasn't sure I had to sent V5C to DVLA to update my new address to registered car. As at time I tonight's sending info for address change on driving license would update all.
        Later in May 2016 I notified DVLA of new address via sending V5C. However yet till date I never received any form of communication from PCM, Court, Solicitor or Debt Collectors.

          If the DVLA database was updated in May 2016 to show your new address, a set aside shouldn't be too much of a problem.
          But you do need to show that, if set aside, you have a reasonable prospect of defending the claim.
          What are the issues surrounding the parking event? (ie why do you think the charge is unjustified?)
          If you do decide to try for a set aside, you can write to the parking management company to get there consent. If they agree it will cost considerably less. If they refuse you can use that to indicate unreasonable behaviour.
          Of course, you will be letting them know your current address, but they can get that easily enough, & should have done so before issuing a court claim.
          You could apply for the set aside, then pay the outstanding amount.
