    Hi,

    I parked in a Whetstone car park, paid by phone using my credit card (to www.phoneandpay.co.uk) but was issued a parking charge notice by Civil Enforcement Limited a few days later. I appealed the parking charge notice from CEL and they wrote back today stating my appeal was unsuccessful.

    In their response letter they stated " Signs in the above car park clearly advise you must enter your full and exact registration number when making a payment for parking. As shown on your Phone and Pay records, on this occasion you did not comply with the terms and condition displayed on the sign."

    I've checked the www.phoneandpay.co.uk website to dig out the transaction and surely enough they have a record of it and an associated receipt. However, the receipt has no detail of the car registration number. I don't know if they recorded my car registration correctly, as I remember, I was asked to "speak the car reg" to the interactive voice registration system (and it didn't play it back to me).

    Four questions,
    1- Do CEL have to tell me the exact reason why my appeal have unsuccessful or are they in a position to simply decline, refer me to POPLA, and reveal their evidence at a later date at the POPLA appeal?
    2 - Is the statement above CEL's explanation of why my appeal was not successful? If so, are they stating that I simply didn't enter the car reg in correctly or did I not comply with "other terms and conditions" which I'm not aware of (parked across two bays, paid for less time than I stayed, etc)
    3 - Is POPLA a fair ombudsman?
    4 - Should I go back to the car park to read the sign again?

    If they are saying you did not enter the correct car reg. then they must show the evidence so i would ask them for it, I'm not the best person to advise on this but somebody should now jump in
