  • Lowell / Bryan Carter - Unpaid CCJ from 2014 - URGENT advice please

    Hi all,

    I have had two issues stopping my mortgage application (one which i have started a differed topic as it is different to this issue)
    Background:

    1. I needed a new staircase (as previously brought uninhabitable home to renovate)
    2. Leaflet came through door, i called and a salesman came out
    3. During his visit he made many sexual references and comments towards me, being a young shy and intimidated female on my own, i just wanted him to go.
    4. In doing so, i signed his sales document thinking i could get him out of the house and later cancel.
    5. I was 1 day over allowance to cancel and the firm refused stating T&C on the reverse of the form (he had it on a clipboard so i did not see)
    6. I stated i didn't want him or any of that company in my house, they stated pay for the staircase i had signed for or end up in court.
    7. They issued a County Court Judgement
    8. I sobbed in court, had to have a intermittent break - they stated they made the individual elements of my staircase in court (provided no invoices or evidence) Stated salesman was married and unblemished 13 year carer. (No comment!!)
    9. I lost.
    10. I stated i would appeal when composed enough for a court. This was instantly denied and refused in that room on that day by that judge
    11. I then contacted the company to install the staircase, they refused stating CCJ was to pay up. I stated they had made my staircase & he laughed.
    12. I requested further clarity from the judge re dead money or for my product. He Refused to provide clarity
    13. I requested court transcripts, they asked for £45 +vat and would take up to 40 days (which was then pointless and a waste of money)
    14. All this took me past my 28 days and a CCJ was lodged on my Credit History.


    Following being turned down for a mortgage, i contacted Credit report companies and the Court house.

    Now i contacted the court this morning and were told to contact Bryan Carter Solicitors - i asked why when i dealt only with the staircase company previously - informed their solicitors.

    So am i right that the CCJ debt has been sold??

    Now i "googled" Bryan Carter Solicitors - am i correct that they dissolved 21st Feb 2017 or is this another group by the same name? https://www.duedil.com/company/gb/OC...solicitors-llp

    My Financial Advisor states he understands how and why i didn't pay for a product i wasn't going to receive but it doesn't help my current situation. He advises to pay up.

    Am i correct that Lowell buy the debt and Bryan Carter were / are their solicitors that chase it down? If no BC would it now be with Lowell?

    Do i pay the £461 - or would i now have additional costs like their charges and interest?

    Please note NO ONE Has chased me since day of judgement but it is now effecting my life and future.

    Any advice, next move??? I don't want to contact Lowell / BC and "awaken" or "acknowledge" the debt but i'm about to loose my dream house in Cornwall.

      From reading your threads they [Lowells] seem to be the purchasers of the debt and Bryan Cater their solicitors that enforce

      If i am incorrect in assuming this, I'm more than happy to be corrected.

        use to , lowells have their own in house solicitors now, who do most cases,

        B rian Careter seem to do more parking charges these days!

          So if the Court has asked me to speak with BC would they not refer me to Lowells? Just trying to find an easy, less stressful and confusing way to resolve this mess! I feel proper stupid for trying to stand up for myself. I had limited knowledge of the long term effects as i already had a mortgage but having sold my house only completed last week and in rented awaiting the purchase of my new one which i found only this week, to have this stumbling block when i have worked incredibly hard to get to where i thought i was successful and financially stable to discover my credit is through the floor is devastating.

            well as seems carter is involved in this case so maybe follow that idea of their.,, but lets see what the peeps on here say especially the Llps

                    My understanding is that BC are no more, dissolved (as you have stated).
                    The CCJ is likely still with the original company.
