Just after some advice with regards a PCN issues by PE.
A bit of a strange one.
On the date in question my Mrs had her car in for repair (Car A) as such she had borrowed my car (Car B) to go shopping.
Inadvertently she entered her full registration (Car A) in to the ticket machine instead of my full registration (Car B)
Obviously the ANPR has detected my car (Car B) entering and leaving and as such flagged up as no valid ticket purchased.
I have had the standard PE letter demanding payment, which I have appealed via their limited website. As expected the appeal has been rejected and they have offered a "Gesture of Goodwill" and reduced the over inflated fine to a slightly less inflated fine of £20.
They state that entering the incorrect registration is a breach of their clear T&Cs and as such the fine stands.
I now have 14 days to appeal or the fine will be increased to the original amount and I will be sent a POPLA code!
I have the following evidence.
1. The ticket purchased for the allotted time on the day in question.
2. Proof of ownership for both vehicles.
3. Correspondence from PE sent via letter and Email
ps. I have previously lost in court to PE for an overstay based on the Beavis case even though the Beavis case was under appeal the judge still claimed it was valid and ruled in PEs favour, ended up costing me £200 so I am a little nervous.
Any help would be greatly appreciated.
