    Hello,
    I received a Civil Parking Charge Notice from Athena ANPR Ltd for exceeding free parking duration at Lidl Shirley in Southampton.
    Allowed duration of stay: 10 mins. Actual duration of stay: 35 mins. They want me to pay £45 within 14 days or £90 afterwards.
    I don't shop at Lidl. I only park there because I do my shopping at the polish store next to/opposite Lidl. I was shopping there and using the same car park weekly for over a year now. I wasn't aware of the camera system and rules at this car park. I think I looked at the signs and I assumed that it's for customers of polish shop as well. There is no fence dividing car park from polish shop. If you look at the sign, it says in big red capital letters: "CUSTOMER PARKING ONLY" and underneath smaller letters: "MAXIMUM STAY OF 90 MINUTES". So after seeing a first bit of the sign I was actually reassured that I'm ok to park there as a polish shop customer. Only when I received a charge notice I went back and looked properly. It says: "Lidl Customers - up to 90 mins - no charge" but it is in much smaller letters! Also the signs are only on the actual car park, not at the gate/entrance to the car park. So there is no information about restrictions when you entering. The pictures they attached to the charge notice were taken on the gate. I would never park there if I knew their rules, restrictions and consequences!
    I would probably go to Lidl for shopping and then to polish shop to make sure I'm covered.
    Do you think I have any chance of winning this?
    I'll try to attach some pictures if needed.

                  Apparently there is a device behind the tills to input car registration number. This way they know if I was shopping at Lidl. Also there are CCTV cameras on the Lidl building so they may be able to check this?

                    What does the Polish shop say about the ticket? Have you been in to see them, taking the PCN with you?

                    Looking at GSV, May 2016, there appears to be no signs on entering Lidl car park, though things may have changed. There is also a raised barrier. So it would seem that it is perfectly feasible to enter the car park, turn right, go shopping in the Polish store and not see a single sign.

                    Looks like next time you'll have to go along to the next road, Jason Road, and then park in front of the Polish shop.

                    You could also give us the location of the signs for Lidl and the location of the camera. I can see the MacDonalds camera.

                      No, I haven't been there to talk to them yet.

                      Finally I managed to upload some pictures

                      You can see the entrance to the car park and location of the camera.
                      There is a small sign by the barrier which says :"Controlled parking area. Terms and conditions apply. See notices in car park for details."

                      Camera is on the supermarket wall, opposite the gate to the car park.

                      On the other pictures you can see where are the notices on the lamp posts opposite polish shop.

                        As it's an IPC firm the chances of a successful appeal, initially or secondary (theias.org) are very slim. The polish shop might be able to help or try the Lidl manager. After all they won't know who shopped there and who keeps shopping receipts

                        It seems you can enter from the left and park on the right without seeing the signs. That'd be an argument for a judge and will not win beforehand.

                          Clock is ticking so I'll appeal today to Athena and take it from there.
                          I'll try to talk to polish shop people and to Lidl manager before tho.

                            Could you please clear one more thing for me?
                            My 14 days to pay a reduced rate expires on 26/10/2016. In my understanding it will be frozen if I submit an appeal to Athena within this time and if they reject my appeal I can still pay a reduced charge. Am I right?

                              Usually firms will extend this in the hope they don't have to pay the fees for a secondary appeal. To be honest if that's a concern then you'd probably be best just to pay because you won't win on an appeal to Athena. Only Lidl and the Poles can help at an early stage.
