  • Excel Parking/BW Legal/Peel Centre

    Hi,

I just wanted to ask some advice about a little bit of a strange situation I've found myself in.

I moved house a couple of years ago, went back to see the new owners this weekend because they've had a baby and in return received a little bag of mail.

First two letters I opened were from BW Legal on behalf of Excel and a letter saying they'd notified the courts (business claims at Northampton) about the case and could start a CCJ about the debt.

    So-
1/ I have no idea what this is about other than it's something to do with parking at the Peel Centre so how do I find out without having to deal with knuckle scrapers
2/ All of the dates and deadlines stated in these letters have passed (one week ironically), so does this mean a CCJ is inevitable because obviously I'm keen to avoid that
3/ This seems to be similar/identical to everything I've managed to google about these people- small fine + large fine+ interest + our legal costs = £242. £242 for a car park?!
4/ I've only been to the centre a couple of times and am as certain as I can be I've always got a ticket and not over stayed my welcome but the last time I went was probably 6months ago, maybe even more so I don't really know how I ago about trying to defend whatever the claim may be too.

All in al very frustrating although the new baby at least was lovely. I'd be grateful for any advice thank you

    1. You can't really.
    2. Depends. Was one of the letters an actual court claim ?
    3. Correct.
    4. Seeking advice on here is a good start.

So the most official letter is a claim form from the county court business centre with a claim number and issue date but no detail about the actual incident just the sum of £232.76 owed (£157.76 claimed, £25.00 court fee, £50.00 legal rep cost) and it does say Peel Centre, 19/2/16 for 'the offence' but no exact details. It is asking for a response whether I agree/partially agree or disagree with the claim (although I don't know what it is).

I can see what other people have argued about like non payment because of poor signage, legalities of them not owning the land the car park is on, legalities of grace period after running out of ticket, ticket paid for but not displayed clearly....I'm not really sure how to start when I'm not sure who to ask about what it is I'm meant to have done. Suspect a call to BW Legal will just be a one ended call of them saying, you owe us the money so just pay it but then I don't want to get in court bother.
