Hi, I'm a newbie and hope I can get some help from you lovely people? ��
1) basically my daughter (she has mental health issues and I am her carer, I usually deal with her paperwork) has been given a PCN for parking through post, in a road where the car was not parked, council photo proves it, no ticket on car;
2) her boyfriend was the driver, he tried to discuss it and they wouldn't, because not her;
3) my daughter tried to sort it online, but computer glitch on site wouldn't allow her to input info, so with delays in paperwork plus computer glitch, out of time.
4) she applied to make SD out of time, with full explanation of delays etc and proof of wrong road (ie, convention did not occur, therefore ticket not valid). This was refused.
5) bailiffs are banging at door threatening to take goods, clamp car etc (I paid for car, so not happy);
6) my daughter is heavily pregnant and thus needs her car, especially with her mental health difficulties because she needs to get to me urgently if panicking.
7) I am disabled myself and under a lot of pressure, so I know she has tried to sort it herself in order to save me the hassle, but now we have double the hassle.
my question is, how can a court enforce a ticket that is invalid due to being issued for a different road? How can I turn it around?
