I need some advice. The DWP wrote me a letter saying they have written to my employer making arrangements for a DEA on my wages. My daughter was 14/16 at the time this issue started and she is now 32yrs. I disputed their error, even evidence showing their error was dismissed. Every couple of years they come back and won't give me proof I feel hounded and stressed all the time. I need help/advice on what to do. And can they do that with my employer. Plus no court action has been taken against me. The council did that same thing to me and they claimed my proof of the council tax debt was for a previous debt but they showed no proof then I'm blown off with we'll call you back while taking over £100 a month. Can DWP do/get an DEA (Direct Earnings Attachment ) from my employer? And what can I do or who do I see. I work part time, term time only. HELP!!

Some points before [MENTION=39710]des8[/MENTION] takes a look for you.
There is no time limit for the DWP to pursue debts.
The DWP does not need a court order to get an attachment of earnings.
Have you informed DWP that you are on a low income?
What benefit was this about?
How much do they claim is outstanding?

Following on Nem's post, if you have completed the DWP's complaints procedure ( https://www.gov.uk/government/organi...ints-procedure) your next step is to involve your MP and ask him to refer the matter to the Parliamentary & Health Service Ombudsman.

Before there is any refund proof is needed whether this alleged debt exists or not stating time scales and compensation figures is a bit premature?
Have we seen from previous threads a result for the alleged debtor from the DWP this Government is chasing money everywhere

I have DWP debt management chasing me for a social fund loan way back from january 1998. I didnt think they could i thought it would be statute barred but apparently new statute laws they can send your employer detachment of earnings order I am trying to fight this and detach myself from legal fiction altogether and live as a freeman of the land the system is getting more and more ludicrous life more and more stressful police are more interested in dishing out fines and parking tickets and act more like debt collectors something is seriously wrong here in the UK. i am making my stand even if i am sadly one on my own

If you are intent on following Freeman of the Land gumf, be prepared to lose!!
IMHO your time would be better spent examining the statute (http://www.legislation.gov.uk/uksi/2.../contents/made) and see if it is being applied properly to your circumstances and your employer.

If the DWP issues an Attachment order your employer cannot refuse to comply.
