BW Legal/VCS threat from Booths Salford media city

I have received a letter from BW legal from an old PCN from 2012 issued for Booths car park at Salford Media City. The driver literally drove in and out the car park. I was advised to reply to the letters issued in 2012 with a cheque for the period of time the car was actually in the car park for and explain i was not legally entitled to pay the fine. The cheque was returned along with a red letter or 2. The letters stopped shortly after. Until this year when i received a letter saying VCS had passed the case onto BW legal. They are now asking for funds again.

What is the best way to proceed?

Look around this forum and the private parking forum of pepipoo and you will see that a lot of claims for old PCN's have been raised, probably hoping to get default judgements because people have moved away.

Can you remember when in 2012 that you received the PCN? The reason is that POFA was introduced in October and that allowed keeper liability. Prior to that it is an easy reply in that the keeper was not driving and they have no claim against the keeper.

So you write back to them and tell them that the incident happened before the introduction of POFA in October 2012 therefore they can only go after the driver at the time, who you do not know, and the keeper, yourself, has no liability in the matter. You do not expect to hear from them again about this matter

There are no templates but search on here and pepipoo for VCS and BW legal and you should find what other people have written.
