      Hi
I would appreciate any advice regarding a Court claim issued by
VCS to my partner for stopping in a no stop zone at Liverpool Airport.
We have a mediation telephone call arranged through the Court to hopefully resolve the dispute because their claim is now £300 rather than the original £60 penalty fee.
I was in Spain and fell down a set of marble stairs te night before I was due to fly home the next morning. I have had 4 surgeries to both knees due to medial meniscus tears which has left them both unstable and frequently give way.
My Daughter has numerous mental health problems including Emotionally Unstable Personality Disorder,Bipolar,Autism to name a few and was being cared for whilst I was in Spain for 3 days escorting my 86 yr old Dad to his GodDaughters apartment for a holiday.
When I fell I absolutely knew I had done some damage to both my leg and wrist but couldn’t risk being refused to fly home to my Daughter so I never went to hospital until I got home to Liverpool.
Long story short, I was in agony on the plane and took a lot more of the medication I am already prescribed for pain and severe anxiety and panic disorder.
I came off the plane and vomited in the concourse , was crying, limping and extremely distressed , not a sole around so I eventually got to the main exit doors and for some reason I decided to walk towards the road at the exit to the airport which was stupid of me as I later found out I had a fractured tibial plateau and fractured wrist. The public footpath has a continuous metal fence all the way to a small service exit road. I kept stopping to be sick , I was crying and couldn’t walk more than a couple of steps without virtually collapsing over the barrier.
A couple walking towards the airport stopped to help me just as my partner pulled up at the side in his works van to help me.He had been sitting across from the airport in the car park and watching me but I didn’t answer his calls so he had no choice other than to get to me. He got me into the van and took me straight to Whiston A&E immediately were they diagnosed the above fractures .I arrived at the hospital 20 mins after the stopping violation ticket is time stamped I have the file notes from Whiston Hospital stating my arrival and X-rays prescription etc…
As I felt responsible for him getting this fine I was going to pay VCS fine and went on their website were it showed photos of his registration and him helping me into his van.In total he stopped for 8 seconds.
As it was a company vehicle he was in lots of trouble so rather than pay the £60!i wanted him to be vindicated due to it being an emergency so he didn’t loose his job.
I tried to upload the time stamped photos of my injuries and hospital evidence etc but their website was down and wouldn’t accept the request for an appeal.
I contacted them directly and explained the situation and said I had sent the them by post.
I received an email sent to SPAM saying they had refused the appeal as they hadn’t received any evidence. By the time I saw the email in my SPAM box I was out of time to appeal.
TWO years later they’ve sent a County Court claim which we have defended with a view to pay only the original £60 fine.
Phoned their solicitors to pay £60 if they would accept it and was told they no longer represent VCS.
The VCS cctv surveillance operator must have seen me struggling to walk and so distressed because I was walking towards his van which he then photographed 6/7 images of and produced in support of the fine on the VCS website.
One of me on my own with part of the van in the photo then another of me being helped into the van and a couple which had the whole van and registration visible.
Any advise on the mediation phone call would be sincerely appreciated..
He did stop in a no stopping area to get me in an emergency but still broke the law by stopping so I will pay the £60 original fine but do we have to pay VCS additional fees for Court applications etc (£300) ????
Many thanks and apologies for the EPIC post
