  • U K Parking Control Ltd

Hi I hope I can get some advice my Daughter had use of my car a couple of years ago and recieved about 6 parking notices from this company (it is a small car park at her home address that is unused. She was told by various neighbours and searched on line and was advised not to pay as they never go any further as not council or TFL tickets and to my horror out of the blue I recieved as notice of enforcement from Marston bailiffs today stating that this was taken to Manchester County court in February this year and transferred to the high court for enforcement and giving me until 25th of April to pay £1403.75. I am horriefied and cannot pay this any advice please

    Hi prawnie,

That sounds like it would have been quite a shock. Were the tickets sent to you as the registered keeper of the car and the judgment from the court is against you ? Did you receive any papers at all other than the original parking tickets ? Nothing from the court at all ?

Who advised you to ignore? ( wish people would stop doing that)

You will have to apply to the court to have the judgment set aside - this carries a cost of £255 - due to not having received the court papers ( if you didn't). Applying to set aside will put the warrant of enforcement on hold so deal with Marstons as well.

You would then have to negotiate with UKPC to get this settled.

What date was the original judgment at Manchester court - you might need to call them to find out more info.

If you only had the original parking notices and nothing further regarding court proceedings then you will have a good chance of having the CCJ set aside - otherwise it is going to sit on your credit file for 6 years. For it to have got to enforcement officers it is going to be a few months since the judgment so it will likely already show on your credit file - so have a check of that. Marstons are unlikely to settle for anything less than the full amount. You can give UKPC a call in the morning and discuss it with them but don't be suprised if they say they have passed it to Marston and its out of their hands now. See what they say first though - explain to them you have had no notice of any court action at all and this is the first you have heard of it.
