  • MET Parking Charge Notice, Stansted

    I've read this Forum with interest re Parking Charge Notices. I've just received such a notice after my partner overstayed her welcome at Starbucks, Stansted.

    I'll happily use your standard letter, and thank you in advance for the assistance you provide.

    Before I do so, I'd like to mention a similar Charge I fought against several years ago at Tesco in Chelmsford. In response to the Notice from Euro Car Parks, I denied being the driver and asked repeatedly (in a long trail of letters) for their legal authority to claim from me. Euro Car Parks eventually passed the matter to their 'bayliffs' which, operating from the same address, I suspected as being a bluff. After further notices, becominging more threatening in nature, the matter eventually went quiet and nothing more was received.

    I understand these 'enforcent' companies act based on a breach of contract law. Is requesting a clear explanation of the legal authority being invoked an appropriate challenge? Certainly, no law is mentioned on the Penalty Charge Notice issued to me, which seems odd if they are demanding cash from me!

    In October 2012 a new law was enacted to hold the keeper liable which stopped the defence, in England and Wales, of i wasn't the driver (unless they didn't meet the strict requirements of course).

    As for the old arguments of penalties and unfairness, they are almost extinct thanks to the supreme court. https://www.supremecourt.uk/cases/uksc-2015-0116.html

    I would say that asking for the authority is a good idea, especially at popla, but in a court you need a judge who cares enough about process and doesn't think of you as a scumbag.

      I'll first appeal to the good nature of Starbucks (the driver was a customer there the whole time) and, failing success there, will use your template with an added dose of requesting their authority. The AOS Approved Operator Scheme Code of Practice is impressively detailed with all its rules and Schedules, but it ain't law!
