On Sunday 15th Nov 2015, I parked in an off-road bay on Wick Lane in Englefield Green, at the junction with the A30. The bay has a dropped kerb and space for 2 cars. There are double yellow lines along the edge of the road on both sides, including across the entrance to the bay. There is also a 'Clearway End' sign (leading from the main A30, just before the start of the bay facing down Wick Lane.
After parking there for over 20 years, I received a ticket, which states' the offence as "Parked in a restricted street during prescribed hours (01)". A charge of £70 has been levied, reduced to £35 if paid within 14 days.
I challenged the PCN the same day, providing photographic evidence that my vehicle was not on the road , but clearly and wholly within the bay.
I received a reply today, rejecting my claim stating:
"I have received your letter concerning the above Penalty Charge Notice and after consideration of the circumstances I have found no grounds for the cancellation of the charge. The 01 contravention is used on Single and Double lines. Signs are not required when there are Double Yellow lines as the restriction is no waiting at any time. The Double Yellow lines cover the highway, footway, and verge. If parking was permitted in the area in which the vehicle was parked, there would not have been Double Yellow lines on the highway. "
So LB - do I have a case for appeal or am I just a victim of assuming that a bay on the side of the road is okay to park in?
