  • Parking Eye and Aldi PCN

    Hi all,

    A few weeks ago I got a PCN from Parking Eye for an overstay of 1 hour on an Aldi carpark. I wrote to Parking Eye using the excellent info from this forum. I asked them for evidence that their signage was compliant. I now have evidence that it's not as the sign at the rear entrance to the carpark is high up on a post and impossible to read the large amount small print on it at that distance. At the same time you have to navigate a narrow one way road with two bends as you enter the carpark. Also where I parked there were no signs close enough to read. The day I parked it was raining quite heavily

    In my letter I also asked them who the landowner was and a copy of the contract between Parking Eye and the landowner and if they had written authority to issue and enforce PCN's on that land.
    I also requested a breakdown of their costs/losses that amount to the £70 charge.

    I did this as registered keeper and haven't told them who was driving at the time. I also have receipts that prove I spent over £70 in the store 5 minutes before the time of leaving the carpark according to Parking Eye's photos and time stamps.

    A few weeks went by and they sent me the "Appeal Failed" letter and a popula code and forms. Which is strange as I didn't appeal. My letter was worded that I required the above information so I could then make an appeal. They also didn't provide any of the information that I asked for.

    I'm wondering what my next steps should be to maximize my chance of getting the information and a good chance of a successful appeal.

        Requested documents attached. My scanner is broken so had to use digital camera instead, so I hope everything is readable.

          Whilst Beavis lost in the supreme court i see no real reason to remove the penalty and unfairness arguments until Popla rule on them.

          That explains entering a popla appeal quite well.

          You only get one shot so enter everything at once. You may need to convert to pdf, i'm not sure on that.
