I recently spoke to xxx who assured me that xxxx hotel were happy with my parking. Sadly Parking Eye have sent a pre court letter before action (scan attached). As you were content my parking was ok please can you call of the dogs, so to speak.

Ok lol i have sent the orig response which you ammended so shall i wait for you to draft a response and then i can send a second email stating the first email didnt contain all the information and then i can also throw in the above comment at the end? [MENTION=5354]mystery1[/MENTION] lol

Dear Parkingeye,

Thank you for your letter of 01/08/2015 headed Letter before county court claim the contents of which are noted.

I notice that you have placed great reliance upon Parkingeye v Beavis. As you are well aware this matter is subject to a reserved decision in the supreme court. I note that the parking event to which you refer was on June 9th 2015 which means there are some 5 and a bit years until any issues with the statute of limitations could potentially come in to play. Should you proceed in haste with this intended action i will request a stay in proceedings and seek costs for "unreasonable behaviour" as per cpr 27.

I will argue that the charge is a unenforceable penalty, you are not the correct claimant, that we did not contract and that any terms deemed to apply are unfair.

As per the pre action protcols i would like a copy of your contract with the landholder and a copy of your contract with myself as well as all parking charge letters.
