PCN - Disabled Bay

Hi,
I am trying to give some advice to a friend who has been issued with a PCN whilst she parked at a B&M store.
Her disabled mum was still in the car whilst she went into the store for 20 mins.
Her car is registered to a disabled badge but unfortunately she did not display it at that time. Apparantly some of the the disabled bays had the disabled signs defaced and hence she thought it was ok to park for a short period of time.

I have asked her to provide pics of the signage and parking bays.

The ticket left on the car was by a company called UKCPS LTD. The incident took place in early June 2015 and she has not received anything in the post from UKCPS LTD yet.

I was going to suggest that she appeal to POPLA rather than the above company.....

Personally, I'd be waiting for the 'notice to keeper' being sent through the post, then appealing to UKCPS asking for a popla code if they reject your appeal

If you can post up pics of the signs etc... I'm sure you'll get lots of advice

My dealings have beeen with CEL/DEAL under diferrent circumstances, but I guess the underlying situation is the same.

Popla not an option as they don't belong to the BPA. They moved to the IPC and the IAS is rank rotten.

Complain to B&M and stick in a quick appeal in the meantime. As long as you don't let them know who the driver is it should be ok.

It may be a case of going through all appeals and seeing if they have the balls to take it to court.

Yes, apparently there some signs to that effect, however I believe Blue badges (issued by the local council) do not have to be displayed in private car parks, only in public areas/roads.

The parking notice left on the car states that appeals have to be made with 21 days and must contain the full name and address of the person. This I suppose, so that they can save themselves the expense of obtaining the info from the DVLA. They also state that they will not process an appeal if the full name and address is not provided in the appeal.

And yes your right M1, they mention the IAS and the IPC.

If a badge is not displayed how would a parking guy know its a disabled driver or passenger using the space?

In the case where they left it on a vehicle you should not reply at all and await a notice to keeper.


As for blue badges, the official scheme has no use on private land. It seems reasonable that landholders could make special provision for disabled people and to identify them make it a requirement for them to display a blue badge.

Ok, so if a private 'landholder' makes provisions for disabled parking, then he could make it a formal condition that a blue badge is displayed.
Could not the fact that a disabled person (who for what ever reason, did not display the badge) use the space be enough to satisfy the condition?

Depends on what the condition says (and what any court would allow them)
