Hi I've just gotten a £70 demand for overstaying my time in Asda Gateshead on 29th May 2015. We parked in a disabled bay as I have a blue badge with being disabled. My daughter is one of the drivers of my car (I'm unable to drive myself) and neither of us realised it was only a 2 hour allowance as the other Asda we go to has a 4 hour allowance presumably as there are other shops there as well and we presumed that it was 4 hours for all Asda car parks.
Is this fine legal as I have been looking at other forums and websites and some of them are saying that Smart Parking and other companies employed by the various supermarkets are not eligible to demand these fines as they are only the agents and not the owners of the land you have parked on. How do I go about challenging the fine, I have my blue badge and can email the details/picture of this but cannot find my till receipts both for the cafe and the store at this time though my daughter is going to look at her house for them though I should be able to provide proof from my credit card statement.
I do find it ridiculous that these supermarkets impose a 2 hour limit on parking as in the case of this Asda, it is a superstore and by the time you get parked(especially at peak times), get a trolley, go for something to eat in the cafeteria (as we did on this occasion which took longer as there was some delay over our order !!), have a chat with each other over the meal then go and do our shopping which included trying several garments on for our upcoming holidays, then go and stand in the usual queues at the tills going through the procedure for buying the goods then taking it out to the car to load up, return their trolley then get out of the car park would challenge able bodied customers never mind disabled, elderly or customers with young children to see to not including trips to the toilets never mind my very slow pace, even if I had used one of the mobility vehicles they supply it would have still been difficult to do all this in the allotted time. Can you tell me what should I do after challenging this fine, they deny my explanation and say I am still liable to pay it?
