    Hi can someone please help. I received a PCN for overstaying in my own parking space? I sent a letter disputing the fine as there was no restriction on time as it was my space. Anyway I stated on the letter I consider any further contact other than a letter cancelling the fine as harassment. After 3 weeks I received no reply and assumed my letter had worked. I subsequently moved address and thought that was the end of it. Today 4 months later I have received an intimidating letter from a debt recovery agency demanding £150 as I did not respond to their letters. The letter also threatens me with other fines like not updating the DVLA with my new address, but I did? I want to send another letter to the PCN company to appeal again on the basis they did not reply in a timely manner and to explain I have moved but I am affrayed they will take to long to reply and the debt recovery agency will up the fine. I have never been in this situation before and I am affrayed this is going to affect my credit rating. Can someone please help with any advise as I dont feel like I should pay any fine.

    Write to them and point out that you do not owe any money for parking on land that is yours and if they continue with more harassment you will sue. (ferguson v british gas, roberts v BOS, Johnson v BOS)

      Hi thanks for the reply. Sorry I should of pointed out it was a parking bay which i had a permit for which was on full display. I live in a flat and the land is owned by a management company on a leasehold basis. I have threatened them with the above case law in my appeal letter. But this has not worked. I am affrayed if I send another letter to explain I have moved and did not receive the previous warning letters that they will take so long to reply the debt recovery will up my fine which they stated they will do in 14 days. Surely them taking so long to reply to my appeal letter is there fault and they should still give me the 14 days grace to pay the lower fine so I can appeal with popla. I don't want to play a game of chicken and lose, I really do not want to go to court.

        Your lease will give you a right to park and the terms of that right.
