This is my 1st post on the forum so thank you in advance for your assistance.
On 31/5/14 I was issued a PCN for parking on a single yellow line and the time of the ticket was 16.07. Due to heavy traffic in the area due to sporting events I was late arriving at my cousins wedding. I parked around the corner from the venue to deliver my wife and son but also the wedding cake that I was delivering. The wedding started at 4pm. The Civil Enforcement Officer observed my vehicle between 16.04 to 16.07 which I believe is less than the 5 minute minimum recommended.
I therefore appealed the PCN on that basis and received a notice of decline of challenge on 7/6/14 as "the civil enforcement officer watched my vehicle and so no loading or unloading going on" and confirmed that "civil enforcement officers can give PCN straight away, they do not have to wait"
I appealed again on 12/6/14 quoting the relevant pages of the Civil Enforcement Officers Handbook and Department for Transport Operational Guidance for Local Authorities: Parking Policy & Enforcement and that I believed that I was entitled to challenge.
This was again declined on 25/6/14 as "it is recommended that if a driver is unloading personal items they do not park on a single yellow line as they will not be able to provide documentary evidence" of the delivery. It also confirmed that my vehicle was first observed at 16.04.16 with PCN issued at 16.07.10 and last photo at 16.08.31 all within 5 minutes.
I wrote back stating that I wanted this independently reviewed at court if necessary. I then received no further correspondence. I have since moved from the property and have just received from the new owner an Order of recovery of unpaid penalty charge (Form TE3) but have missed the date of 04/01/2015 and now a notice of enforcement from collect services debt collectors who want £247 plus cost of an enforcement stage of £235 as they have visited my old address. I have called collect services and informed them I have moved and that I am not paying them. I believe my original debt is still the responsibility of Ealing Council but the automated telephone line directed me to connect services.
I am willing to pay the original £55 to fully discharge the debt but no more. I was just wondering what my next actions should be? Thank you.
